Chicago ain't playing with Jussie Smollett! The city has officially filed a lawsuit against the actor in which they claim he owes over $130,000 to cover police investigating in the reportedly "phony" hate crime case created by Jussie.

According to Chicago Sun Times , the lawsuit was filed on Thursday in Cook County Circuit Court. This happened to be 16 days prosecutors from the Cook County state's attorney office dismissed all criminal charged held towards Smollett.

The "Empire" star reported to the police in January stating that he was a victim of a racist and homophobic attack in Streeterville. After several weeks of investigation, the Chicago Police Department came to the conclusion that Jussie had a plant a fake attack -- hiring two brothers to act like attackers -- based on not being happy with his salary on "Empire."

As reported earlier in the month, Chicago threatened to sue the actor if he did not turn in $130,000 for the cost of investigating the alleged "fraud" case. In addition, they sent a letter to Jussie's legal team in which they responded back telling the city to "go pound sand," according to TMZ.

The city has said the cost of the investigating the case has caused them over $130,000 and that they would like the thousands of dollars they spent on top of the $130K to cover for fees.
